IMPORTANT NOTICE: Please read carefully.

APPLICATION FOR SUBSCRIPTION

Applications for subscription to the Portal may be made using the Online Registration Form. Upon completion of the required fields, please print out the same and forward it together with the requisite Fee to the SC.

Password to grant access to the Portal will be sent to the Contact Person by e-mail.

Subscribers are reminded to pay the Fee to renew their subscriptions on or before the expiry date of the same.

Persons who are not Qualified Investors may be granted access to the Portal under limited circumstances on a case-by-case basis at the sole and absolute discretion of the SC. Written applications, stating reasons for access to the Portal, may be directed to DS@seccom.com.my.


RULES FOR SUBSCRIPTION

Only Qualified Investors may apply to subscription to the Portal, and the Portal will continue to remain available to the Subscriber only for as long as he remains a Qualified Investor. Subscription to the Portal may be granted to other persons in limited circumstances at the SC�s sole and absolute discretion.

The Contact Person shall be deemed to be a servant of the Subscriber, with the necessary authority to act on behalf of the Subscriber, and all acts errors and omissions of the Contact Person shall be construed as acts errors and omissions of the Subscriber.

The SC reserves the right to accept or reject an application for, or to suspend, reactivate or terminate, a subscription to the Portal at its sole and absolute discretion.

If the SC does not receive the Fee on or before the expiry of the Period, the Subscriber�s access to the Portal will automatically be suspended, and reactivation of the subscription to the Portal will be at the SC�s sole and absolute discretion.

In the event an application is not accepted by the SC, the Fee will be refunded within 30 days of the communication of such decision.

In the event a Subscriber�s subscription is terminated, a proportionate amount of the Fee will be refunded within 30 days of such termination.


REPRESENTATIONS AND WARRANTIES
 
While all reasonable attempts are made to ensure good maintenance of the Portal, the SC makes no representations or warranties regarding the speed or availability of the Subscriber's connection or accessibility to or in the Portal, or to or in an IM or TD.

While all reasonable attempts are made to ensure accuracy and completeness of IMs and TDs in the Portal, the same are furnished to the SC by third parties for none of whom the SC is an agent, and the SC makes no representations or warranties regarding the same.

The IMs are provided for historical information only and the TDs are provided for information only. Neither the IMs nor the TDs constitute an offer or invitation to purchase the securities they relate to. Subscribers are reminded to consult their advisers before making any investment decision.


DEFINITIONS

"Contact Person" means the person who is designated as the same by a Subscriber, and includes any successor or replacement. 

"Fee" means the annual subscription fee of RM240-00, or such other amount as may be prescribed by the SC, per Subscriber.

"IM" means any one or more of the Information Memorandums for the outstanding Ringgit denominated bonds approved by the SC from 1 January 2005, and are made available on this Portal.

"Portal" means this web portal in which IMs and TDs are made available to the Subscriber.

"Qualified Investor" means an investor who falls within one or more paragraphs in Schedule 2 Securities Commission Act 1993.

"Subscriber" means the person, whether an individual or corporation, who subscribes to this Portal and includes his servants, employees and agents.

"Period" means the subscription period of 12 calendar months.

"TD" means any one or more of the Trust Deeds for the outstanding Ringgit denominated bonds approved by the SC from 1 July 2000, and are made available on this Portal.
