Technical Note No. 1/2017 - Submission and Notification of Information and Documents by Corporations Listed on Bursa Malaysia Securities Bhd Under Subsection 319(1) and 319(2) of the Capital Markets and Services Act 2007

Subsection 319(1) of the Capital Markets and Services Act 2007 (CMSA) requires a listed corporation to concurrently submit to the Securities Commission Malaysia (SC) a copy of its audited annual accounts and its interim and periodic financial reports (documents) when submitting, announcing or making available such documents to Bursa Malaysia Securities Bhd (the Exchange).
Subsection 319(2) of the CMSA requires a listed corporation to notify the SC in writing of the following:
of any change in the registered or business address of the listed corporation;
if the chief executive or any of the directors of the listed corporation ceases to hold office as a chief executive or director; and
of the names and particulars of any new chief executive or director of the listed corporation.
The submission, announcement or making available of such information and documents to the Exchange by a corporation listed on Main Market, ACE Market and LEAP Market will be regarded by the SC to have complied with subsections 319(1) and 319(2) of the CMSA.
Notwithstanding paragraph 3, the SC reserves its right to exercise any of its enforcement powers against a listed corporation where such corporation fails to comply with these requirements.
