Concern on the SC and/or SC Employee

SC strives to undertake its function with integrity, accountability, decorum and professionalism while ensuring its objectives are met.

At all times, SC employee must do what is right when discharging duties to uphold the good name and reputation of the SC. It is therefore essential that improper conduct are detected and reported, and the concerns raised managed appropriately.
  • How to raise a concern?

    There are two channels provided:

  • What should be included in the concern raised?

    Concern raised should be true and accurate with relevant information which includes the following:

    • Whistleblower’s particulars, such as name, telephone numbers and email address.
    • The name of department or details on person (s) reported on.
    • Specific details of how and when the matter of concern occurred.
    • Any other information which is relevant, and that may assist SC in assessing the concern.

    While all concerns raised will be considered, it is encouraged for Whistleblower to disclose their identity to ease the assessment process.
  • What happens after a concern is raised?

    Each concern raised will be reviewed and assessed as per SC’s establish Policies and Procedures. Where information is insufficient or further clarification is needed, the Authorised Person may contact the Whistleblower. This is an important process to enable us to verify the concern and obtain further information to assist us in making an assessment.

    It is the SC’s policy to treat all concerns received on a confidential basis. As such, the SC will not disclose any sensitive information relating to the concern to anyone, unless the information has been made public and/or the disclosure is required for any regulatory action.

    The SC will process, and address concerns raised in good faith and will not entertain any concerns which are considered frivolous or vexatious. We view the making of false complaints/whistleblowing as a very serious matter.
  • Protection given to Whistleblower

    The SC shall protect the confidential information from the concern raised by the Whistleblower from unauthorised disclosure. The information provided and Whistleblower’s identity will be kept secret under section 140 of the Securities Commission Malaysia Act 1993 (SCMA).

    Separately, you may also seek protection under the Whistleblower Protection Act 2010 (“WPA”). If you are eligible for the protection, you will be granted the following protections:

    • Confidentiality of information & identity.
    • Immunity from civil and criminal liability for the disclosure.
    • Protection from detrimental actions: Whistleblowers are shielded from detrimental actions or retaliation taken by their employers or others in response to their disclosures. These detrimental actions can include demotion, termination, harassment, or any other form of reprisal.

    Any protection granted to Whistleblower under the WPA may be rejected or revoked in cases of disclosures that are:

    • Frivolous or vexatious.
    • Disclosing information to any 3rd party before or after receiving WPA protection.
    • Primarily questioning government policy or public body policy.
    • Known to be false or untrue by the whistleblower.
    • Made to avoid dismissal or disciplinary action.
    • Where the whistleblower participated in the disclosed improper conduct.
    • Where the whistleblower commits an offense under the WPA.
    • Disclosures containing information prohibited by written laws (e.g., Official Secrets Act 1972).

    Complainants can apply for WPA protection through completing the Whistleblowing Form.
